Article 2: Subject Matter
The purpose of these general terms and conditions is to define the terms and conditions for the sale and delivery of products, as well as to define the rights and obligations of the parties in this context. They apply to all online sales on the https://vitaline.shop website offered by Source Nutrition.
Source Nutrition offers Vitaline, a nutritional mix, for sale as a one-time purchase or by subscription.
Article 3: Product Characteristics
Before placing any order, Source Nutrition recommends reviewing the nutritional information and allergens of the product on the website. As the nutritional composition of each product is clearly displayed on the website and on each order, Source Nutrition cannot be held responsible for consumer intolerances or allergies and will not refund the order.
The nutritional information and advertising for all products sold comply with the standards in force in France and EU legislation.
Article 4: Price
The prices of our products sold through our website are indicated in Euros, all taxes included (VAT + any other potential taxes), unless otherwise stated and excluding specific shipping costs.
For orders outside of mainland France, the consumer is the importer of the products concerned. Customs duties, other local taxes, import duties, or state taxes may be payable in some cases. These duties and sums are not the responsibility of Source Nutrition. They will be at the consumer's expense and are their responsibility (declarations, payment to competent authorities, etc.). We invite the consumer to inquire about these aspects with the relevant local authorities.
Article 5: Order
To place an order, the consumer must select the products of their choice and place them in the basket. It is possible to access the summary of the basket at any time, as long as the order is not definitively validated, and to correct any errors in the entered elements.
After ordering the basket, the consumer is invited to provide their details for delivery and billing purposes. It is necessary to fill in all fields, except those indicated as optional. Orders that do not contain all the required information cannot be validated.
For the proper processing of the order, and in accordance with article 1316-1 of the Civil Code, the consumer agrees to provide truthful identification elements.
Article 6: Subscription
Vitaline subscriptions allow you to order your meals on a recurring basis. When creating the subscription, the consumer chooses the products, delivery frequency, and validates their basket like a classic order. All information concerning the subscription is available on the dedicated subscription page. The consumer can manage their subscription in the Manage your subscriptions section of their customer account.
The subscription entitles the consumer to a 10% reduction on the price of the items subject to the subscription.
The subscription is non-binding. The consumer can decide to temporarily stop or definitively cancel the subscription at any time. Cancellation is done in the Manage your subscriptions section of the customer area. They must click on "Manage your order" then select "Delete this subscription". A confirmation popup allows for the definitive deletion of the selected subscription. The cancellation will take effect after the delivery of the last order for which the consumer has been charged.
Article 7: Invoicing and Payment
The consumer can make payment by credit card (CB, VISA, MasterCard, American Express) or Bitcoin. Secure online payment by credit card is processed by Stripe, Source Nutrition's payment provider. Once the payment is initiated by the consumer, the transaction is immediately debited after verification of the information. By validating the transaction, the consumer authorizes Source Nutrition to debit their card for the amount indicated. The consumer confirms they are the holder of the card to be debited.
In the event of an error during validation or false banking information, the transaction and the order are canceled.
Article 8: Order Confirmation
After validation of the order, the consumer will receive an email confirming the payment of the order, as well as an acknowledgment of receipt of the order confirmation. Source Nutrition reserves the right to refuse the order, for example for any abnormal order or for any legitimate reason.
Article 9: Delivery
Products purchased on the vitaline.shop website are delivered internationally.
The consumer is informed during the order of the possible delivery methods for the ordered product(s) and the corresponding fees for each method.
Delivery rates and various delivery methods are available on the Payment and Delivery page by clicking here. Delivery will be carried out by a carrier approved by Source Nutrition.
Product deliveries are made to the address indicated during the order as the "delivery address" within the period indicated during order validation.
Please note that delivery may be subject to postal delays or other events beyond the control of Source Nutrition.
The consumer is informed as soon as possible in the event of unavailability of the ordered product. It is then possible to obtain a full refund of the amount paid or to modify the order.
Article 10: Right of Withdrawal
The consumer has a period of fourteen (14) completed calendar days to exercise their right of withdrawal from the date of receipt of the ordered products without having to justify reasons or pay penalties, with the exception of return costs.
To exercise the right of withdrawal, the buyer must contact Source Nutrition by sending the following withdrawal form with acknowledgment of receipt:
Download the withdrawal form.The consumer will then return the products to Source Nutrition at their own expense by any useful means. These must be returned in their original condition. In this context, the consumer's liability is engaged. Any damage suffered by the product on this occasion may defeat the right of withdrawal. Similarly, an opened product cannot be refunded.
Source Nutrition refunds the consumer for the amount of the order, except for consumed products. This refund is made as soon as possible and at the latest within thirty (30) days following the date of receipt of the returned products.
In case of exercise of the right of withdrawal, Source Nutrition will proceed with the refund of the amounts paid via the same payment method as used during the order.
Article 11: Right of Refund
In case of exercise of the right of withdrawal, Source Nutrition undertakes to refund the client the amounts paid without charge within a maximum period of 30 days, if the products are returned in their original packaging and are intact. The consumer can return the product in its original unopened packaging without any deterioration to Source Nutrition for a full refund. The consumer must bear the costs of returning the package to Source Nutrition at 1 rue Dumouriez, 92500 Rueil Malmaison (France).
In accordance with article L.221-24 of the Consumer Code, the company may defer the refund until the recovery of the goods or until the consumer has provided proof of the shipment of these goods.
Article 12: Receipt and Verification of the Order
Deliveries are accompanied by an invoice for the order (available in the order shipping confirmation email).
The consumer is responsible for the proper receipt of their products. Packages shipped by Source Nutrition are delivered without the recipient's signature.
Source Nutrition is not responsible for the theft or loss of the package once it has been delivered to the consumer and proof of delivery has been provided by the carrier.
If the consumer is present during the receipt of the package, they must check (or have checked by the representative receiving the products) the condition of the packaging before accepting the package.
In the event of an anomaly (missing product(s), damaged package, broken products, etc.), the consumer must contact Source Nutrition, which will indicate the information to be transmitted: number of missing/damaged items, detailed description of the damage, and photos (open or torn packaging, internal damage). It is necessary for the consumer to keep the items in the state they were delivered to proceed with a claim against the carrier.

As the nutritional composition of each product is clearly displayed on the website and on each order, Source Nutrition cannot be held responsible for a consumer error regarding their intolerances or allergies to certain ingredients. Intolerance or allergy cannot therefore serve as a basis for a refund.
Article 13: Protection of Personal Data
As part of the sale, Source Nutrition collects personal data (name, address, email, payment data). This data is necessary for order processing and managing commercial relations. In accordance with the GDPR and the Data Protection Act, the Client has a right of access, rectification, opposition, and deletion of their data. Article 14: Legal Warranties
The seller guarantees the conformity of the products to the contract, allowing the buyer to make a request under the legal warranty of conformity provided for in articles L. 217-4 and following of the Consumer Code or the warranty against hidden defects under articles 1641 and following of the Civil Code.
1. Warranty of Conformity: The consumer has a period of two years from delivery of the goods to obtain repair or replacement in case of a conformity defect. They are exempt from providing proof of the defect during the 24 months following delivery.
2. Warranty against Hidden Defects: The consumer may decide to implement the warranty against hidden defects of the item sold under article 1641 of the Civil Code. In this case, they can choose between the cancellation of the sale or a reduction in the price in accordance with article 1644 of the Civil Code.
Article 15: Liability
15.1. Site Use: Source Nutrition strives to ensure the availability of the vitaline.shop site. However, it cannot be held liable in the event of service interruption, the presence of computer viruses, or damage resulting from a fraudulent intrusion by a third party.
15.2. Products: The products sold comply with current French and European regulations. Source Nutrition's liability cannot be engaged in case of improper use of the product by the Buyer (non-compliance with preparation or storage advice, or consumption after the Minimum Durability Date).
15.3. Indirect Damages: Source Nutrition's liability is limited to the amount of the order placed by the Buyer. It cannot be held liable for indirect damages (loss of operation, loss of opportunity, etc.) that may arise from the purchase of the products.
Article 16: Applicable Law and Jurisdiction
These General Terms and Conditions of Sale are governed by French law. In case of translation, only the French version shall prevail. Failing an amicable solution, the French courts shall have exclusive jurisdiction.
Article 17: Consumer Mediation
In accordance with the provisions of the Consumer Code regarding the amicable settlement of disputes, the Client may use the mediation service to which Source Nutrition belongs free of charge: CM2C, which can be reached via www.cm2c.net, litiges@cm2c.net, or by mail at: 49 rue de Ponthieu 75 008 PARIS.
European Online Dispute Resolution (ODR) Platform: In accordance with Article 14 of Regulation (EU) No. 524/2013, the European Commission has set up an Online Dispute Resolution platform, facilitating the independent out-of-court settlement of online disputes between consumers and professionals in the European Union. Article 18: Force Majeure
The performance of Source Nutrition's obligations hereunder is suspended in the event of a fortuitous event or force majeure that prevents its performance. Source Nutrition will notify the client of the occurrence of such an event as soon as possible.
Article 19: Modification of the Terms
Source Nutrition reserves the right to modify these General Terms and Conditions of Sale at any time. In the event of modification, the applicable Terms are those in effect on the date of the order placed by the Buyer.
